NJ Medical Malpractice Lawyers Successfully Try Case of Medication Error

The family of an Ocean County woman was awarded a $1,350,000 settlement following the death of a 62 year old wife and mother of three. The woman passed away after having an allergic reaction to hypertension medication that was given to her by her cardiologist.

Malpractice lawyers Cerussi & Gunn, PC, represented the woman’s family and oldest daughter who was with her mother at the time of her passing. Despite being a patient of the defendant doctor for more than 10 years, lawyers argued that the doctor overlooked indications in the woman’s chart and medical records that noted that such hypertension medication was a contraindication for this particular patient due to sulfa drug allergies.

The deadly incident began after a visit to the decedent’s family physician due to a severe migraine. The defendant physician advised that the migraine was due to her hypertension and prescribed her with the fatal medication. Later that evening after taking a sample pill that the defendant had supplied, the victim fell ill with nausea, dizziness, and fatigue. Upon calling the pharmacy, the victim’s daughter learned that the medication prescribed to her mother was contraindicated in patients with sulfa allergies. The victim was taken to the hospital by ambulance, her lungs filled with fluid and she passed away.

The physician was sued for medical malpractice and the daughter brought her own claim for emotional distress. The decedent left a husband and three adult children.

The case settled prior to trial for $1,350,000 including $1,000,000 from the physician and the balance from the practice itself.
