EPA acts to ensure safe drinking water for Montana residents

The U.S. Environmental Protection Agency Region 8 issued 19 notices of violation and 16 administrative orders in Montana from June 2006 through March 2007.

Even though Montana has primary authority over the Safe Drinking Water Act, EPA can take federal action against public water systems in the State that violate the SDWA and its regulations. EPA and Montana have developed a joint state/federal workshare arrangement that recognizes limited resources in Montana’s Public Water Supply Bureau whereby EPA provides federal assistance with selected enforcement cases. EPA and Montana work together to identify the public water systems against which EPA will take federal action. EPA is first required to issue a notice of violation to the State before EPA takes a federal action against a public water system in Montana. EPA issued notices of violation to the State, followed by administrative orders to the following Montana public water systems:

Darby, Town of, Darby, Mont.
Emmanuel Lutheran Church, Shepherd, Mont.
First Student, Inc., Billings, Mont.
Golden Eagle Water Users Association, Billings, Mont.
Grace Lutheran Church Childcare and Preschool, Hamilton, Mont.
Church of Jesus Christ of Latter Day Saints - Frenchtown Church, Frenchtown, Mont.
Lincoln Road RV Park Inc., Helena, Mont.
Mountain View Trailer Court, Missoula, Mont.
Oak Ridge Estates, Billings, Mont.
Oasis Bar and Café, Wolf Creek, Mont.
Pioneer School District 41, Billings, Mont.
Richland County Valley View Water, Sidney, Mont.
Town and Country Lanes & Bar, Billings, Mont.
Ulm School District 85, Ulm, Mont.
Whitewater School District, Whitewater, Mont.

EPA issued notices of violation to the State, without subsequent EPA administrative orders, for the following public water systems:

Monforton School District 27, Bozeman, Mont. – water system returned to compliance, no enforcement action issued
Potomac Store L.L.C., Bonner, Mont. – the State took enforcement action instead of EPA
Silverado RV Park, Eureka, Mont. – the State took enforcement action instead of EPA
