Androgel Lawsuits Scheduled for Late 2016 Trial, Judge Says

U.S. District Judge Matthew Kennelly outlines a process by which bellwether trials will be selected and a potential calendar dates for Androgel trial.

Multidistrict litigation (MDL) for lawsuits alleging injuries from testosterone therapy was established in the Illinois court in June 2014, after a growing number of similar testosterone cases were filed in courts across the country.  When the MDL for Low T lawsuits was first presented, there were only 45 cases filed. Judge Matthew Kennelly is now overseeing more than 223 Low T lawsuits and legal experts predict that number will grow into the thousands.
 
In recent years, use of low testosterone therapy drugs has grown significantly. Hundreds of thousands have been spent on mass media advertising promoting the use of these drugs targeting middle aged men with symptoms such as diminished sex drive, low energy levels, and weight gain. These advertisements suggest if you are a man with these symptoms, you most likely suffer from low testosterone. With severe side effects now being brought to attention, the FDA announced it will be taking another look at the safety of these products.


Many men have filed Low-T drug lawsuits against the manufacturers of these low testosterone therapy products. Allegations have been made by the plaintiffs that the therapy led to severe side effects including heart attack, stroke, and blood clotting. The plaintiffs further assert that manufacturers failed to provide proper warning about the heart attack risks associated with these drugs. While the defendants in these cases include a number of testosterone therapy manufacturers, the majority of the lawsuits have been filed against Abbott Laboratories and AbbVie, Inc., the manufacturer of the popular testosterone drug, Androgel.
 
Judge Kennelly filed the recent case management order on November 6, outlining the process by which 6 bellwether trials will be chosen. Those cases will only include the testosterone drug Androgel. The findings in those cases could have an impact on lawsuits against other testosterone manufacturers.  At this time, the first 3 bellwether trials are scheduled to begin sometime in October 2016. The remaining 3 should be completed by April 2017.
