Government deny secret deal on Mesothelioma Claims

The Civil Justice Minister, Lord Faulkes, has denied that there was a secret deal made behind closed doors with the Association of British Insurers (ABI) and the Government on mesothelioma claims.

The Civil Justice Minister, Lord Faulkes, has denied that there was a secret deal made behind closed doors with the Association of British Insurers (ABI) and the Government on mesothelioma claims.

The agreement is apparently in relation to the Government removing the exemption for mesothelioma claims in the Legal Aid, Sentencing and Punishment of Offenders Act (LASPO), which results in significant savings for the insurance industry. In return, the insurance industry will fund the Mesothelioma Act 2014.

These allegations have come to light following a Justice Select Committee hearing about mesothelioma claims. The committee looked into the Government’s decision to withdraw the exemption on mesothelioma in relation to the payment of legal costs. The ending of the exemption would result in many sufferers having to pay legal costs out of their damages. This would save insurers tens of thousands of pounds in legal costs. The insurance industry would then fund the Mesothelioma Act 2014, an act which pays compensation to mesothelioma sufferers who cannot trace an insurer.

These changes would result in many terminally ill sufferers receiving greatly reduced compensation for the harm caused by this deadly disease.
