Power Nissan Of South Bay Sued For Alleged Financing Violations and Failure to Disclose Rental Car Histories

Power Nissan of South Bay, the Hawthorne, California new and used car dealership, has been named in a lawsuit filed in California’s Los Angeles County Superior Court.  The lawsuit alleges that the dealership sold a used automobile to a consumer without disclosing the fact that it was previously registered as a rental car and falsified the down payment amounts in the purchase contract. The lawsuit was filed by the Vachon Law Firm, a prominent Southern California lemon law and consumer rights law firm. The case is titled Calvelo v. Power Nissan Of South Bay, et al. (Case No. YC069605).

Lawsuit’s Allegations Against Power Nissan of South Bay

According to Michael Vachon, Esq., the attorney representing Wayne Calvelo, the consumer Plaintiff alleges that Power Nissan of South Bay concealed and fraudulently failed to disclose the fact that the used Nissan Armada purchased by Mr. Calvelo had previously been registered as a rental vehicle - a disclosure that is mandatory under California law whenever the dealer knows this to be the case.  The lawsuit goes on to allege that the dealership did this in order to trick the Plaintiff into paying a higher price.  The lawsuit also includes allegations that Power Nissan of South Bay illegally falsified the down payment amounts listed in the purchase contract in order to get the consumer financed for an auto loan for which he otherwise would not have qualified.

Based on these claims, Vachon has included in the lawsuit’s Complaint causes of action for common law fraud, violation of the Consumers Legal Remedies Act, violation of the Automobile Sales Finance Act, violation of the Credit Services Act of 1984, breach of the implied warranty merchantability, as well as unfair competition.  Click here for more information about the lawsuit on the Website of the Plaintiff’s attorney.

Power Nissan of South Bay has denied all of the lawsuit’s allegations.

The Los Angeles Superior Court has not yet ruled on the case or determined whether or not the Complaint’s allegations are true.
