Houston, TX February 22, 2013 –For most people, contacting a cruise ship lawyer is not usually something they may want to do immediately after returning from their cruise. However, for the over 3000 unlucky passengers aboard the Carnival Triumph this is exactly what many are doing.

After five days stranded aboard a disabled vessel without adequate food or working toilets, the weary travelers were thankful to be finally back on land after the ship was towed to Mobile, Alabama.

All of the over 4200 passengers and crew were stuck on the crippled vessel for several days without power, heat, or air conditioning. Many of the toilets were not working and it wasn’t long before raw sewage seeped down the walls and over the floors of the ship.

They were offered a limited amount of food which they had to wait in line for hours before eating.“Triumph was tragedy; the trip of a lifetime became the vacation from hell.” said Attorney Darren Miller, owner of D. Miller & Associates, PLLC.

“To add insult to injury, what Carnival is offering is ‘insulting’! We believe we have a way around the limiting ticket provision and at no cost to you if we make no recovery.” Mr. Miller’s firm has been approached by several passengers that were aboard the ill-fated Triumph cruise ship to file a lawsuit against Miami-based Carnival Cruise Lines.

Passengers May be at Risk of Injury or Illness
While the fine print on Carnival’s cruise tickets state that the cruise line is not “liable to the passenger for damages for emotional distress, mental suffering/anguish or psychological injury of any kind.”, it also includes this provision: “… except when such damages were caused by the negligence of Carnival and resulted from the same passenger sustaining actual physical injury, or having been at risk of actual physical injury.”

All 4,229 crew and passengers on board the Carnival Triumph are at serious risk of physical injury and diseases including Hepatitis A. According to the Centers for Disease Control (CDC), Hepatitis A is can be transmitted as a result of unsanitary conditions such as those experienced aboard the Carnival Triumph and can have an incubation period of around 28 days.

Passengers are recommended to contact their medical professional if they develop any symptoms of illness such as fever, abdominal pain, nausea and vomiting.
