“It appears that Carrier IQ has been receiving the contents of a number of text messages-even though they had told the public that they did not.”—U.S. Senator Al Franken

Carrier IQ is a software that has been allegedly installed on many wireless devices and is potentially recording and sharing user data, including text messages, emails and internet browsing. It has been alleged that most major wireless companies and cell phone manufacturers have installed Carrier IQ software on their wireless devices such as smart phones, mobile phones, PDA, and Tablets and may be transmitting sensitive information. This software is supposedly capable of recording each and every keystroke the user inputs. Even scarier yet is the allegation that the owner/user of a device with this software installed would have no idea it was running and no ability to disable or delete it without potentially waiving warranties. The use of this rather alarming program by your wireless provider and by Carrier IQ may be in direct violation of Federal privacy laws such as the Stored Electronic Communications Act and the Computer Fraud and Abuse Act.

U.S. Senator Al Franken, Chairman of the Senate Subcommittee on Privacy, Technology, and the Law, has been instrumental in bringing this possible violation to light. Sen. Franken contacted the wireless companies accused of using the Carrier IQ software and Carrier IQ for an explanation of how the software is being used. According to Sen. Franken’s website, http://franken.senate.gov: “People have a fundamental right to control their private information. After reading the companies’ responses, I’m still concerned that this right is not being respected. The average user of any device equipped with Carrier IQ software has no way of knowing that this software is running, what information it is getting, and who it is giving it to-and that’s a problem…I’m also bothered by the software’s ability to capture the contents of our online searches-even when users wish to encrypt them.”

AT&T, Sprint, HTC and Samsung are among the mobile phone companies that have been accused of installing and possibly using the Carrier IQ software. The software appears to have been installed on millions of wireless devices without the user’s knowledge, much less their explicit consent.
