Rottenstein Law Group Looking Forward to Fosamax Multidistrict Litigation Progress After Formation of Steering Committee

The federal court, handling multiple Fosamax cases with regard to pre-trial matters, last month established leadership committees of counsel and assigned certain plaintiffs’ lawyers to those committees. Case Management Order No. 3 in Civil Action No. 08-08, In Re: Fosamax (Alendronate Sodium) Products Liability Litigation (No. II), was signed by the Honorable Garrett E. Brown, United States District Judge, of the United States District Court for the District of New Jersey on July 14.

The order established a Plaintiffs’ Steering Committee, designating eleven attorneys from firms in eight different states to serve on the committee. The Steering Committee will be responsible for coordinating the plaintiffs’ activities during pre-trial proceedings.
The United States Panel on Multidistrict Litigation had previously, by an order dated May 23, 2011, in case number MDL 2243, ordered that 36 actions against defendant Merck, Sharp & Dohme Corp. (formerly Merck & Co.), pending in eight federal districts, be consolidated in the United States District Court for the District of New Jersey and, if possible, assigned there to Judge Brown.

The U.S. Food and Drug Administration (FDA) issued a Fosamax warning in October 2010, stating that bisphosphonates cause rare low-impact femur fractures. Dozens of lawsuits were filed against the manufacturer in various federal courts after the warning was issued. The suits allege, among other things, that Merck failed to not only adequately test the drug, but to also warn users of its dangers.
