The Sedona Conference® Announces Publication of "The Sedona Conference® Cooperation Guidance for Litigators & In-House Counsel"

SEDONA, Ariz., June 3, 2011. The Sedona Conference® announced today that it will release the public comment version of The Sedona Conference® Cooperation Guidance for Litigators & In-House Counsel on June 8, 2011, following a webinar scheduled for June 7, 2011.

In the 90-minute webinar, four members of the Commentary’s drafting team will identify and discuss opportunities for constructive, mutually beneficial cooperation with opposing counsel and will provide pointers on how to take advantage of such opportunities. The panel will also discuss the benefits of cooperation, while highlighting some of the consequences of non-cooperation, such as increased costs, increased court intervention, and increased risk of sanctions. The panel will include Richard G. Braman, Board Chair of The Sedona Conference®, Timothy Moorehead, senior litigation attorney for BP America Inc., plaintiff class action litigator Ariana J. Tadler, and A. Michael Warnecke, a corporate litigation and criminal defense attorney.
The Sedona Conference® issued its Cooperation Proclamation in 2008, launching a coordinated effort to promote cooperation by all parties to the discovery process to achieve the goal of a just, speedy, and inexpensive determination of every action. In an effort to reach this goal, The Sedona Conference® envisioned a three-part process: (1) awareness of the Proclamation itself, (2) commitment to cooperation, as described in The Sedona Conference’s® “The Case for Cooperation”, and now (3) The Sedona Conference® Cooperation Guidance for Litigators & In-House Counsel, the practical toolkit designed for training and supporting lawyers in techniques of discovery cooperation, collaboration, and transparency.

The webinar on the Cooperation Guidance Commentary will be held Tuesday,
June 7, 2011, at 1:00-2:30 p.m. EST, and the Commentary will be made available to participants during (or before) the program. Registration is now open for the
