HolidayTravelWatch Hails decision by Judge for Holidaymakers in Sick Hotel Claim!

HolidayTravelWatch hails the decision handed down by Judge Worster at Birmingham County Court, in favour of a group of 49 UK holidaymakers! Amongst her measured comments, she held that Tui were wrong to send holidaymakers to the Hotel Son Baulo in Majorca in 2003, knowing that previous holidaymakers had also suffered illnesses! HolidayTravelWatch received reports from UK holidaymakers in 2003, and provided them with assistance following their confirmation that they had acquired Cryptosporidium and other unconfirmed illnesses.

Subject to any appeal the tour operator may decide to make, it is likely that these Consumers will finally be compensated after nearly 8 years of legal battle!

HolidayTravelWatch has vigorously campaigned since this case that the practice must stop; tour operators have sufficient warnings systems to alert them to growing illness problems either within a hotel/resort or on a cruise ship.

HolidayTravelWatch has argued before Westminster and the EU Commission that more must be done to stop EU holidaymakers being exposed to ‘risk destinations’, by recognising the risk that arises from failing to react or deal with serious health and safety issues.

“In January 2010 I was accused by a tour company of being ‘alarmist’ in a similar scenario, for suggesting that criminal offences should be introduced into the Package Travel Regulations, for the failure to report to health authorities of any outbreak of illness and further of, ‘introducing’ holidaymakers to the risk of a known illness! It is clear that drastic action is required and again lawmakers need to heed this call. It matters not to me what further description is offered following my comments; it is no longer tenable for tour operators to cry that ‘local standards apply’! I would suggest that all tour operators read the comments of the learned Judge and put an end to these ‘risk destinations’ before someone dies!”
