Cherry Hill Defense Attorney Protects the Rights of Clients Accused of Drunk Driving

WEBWIRE

Hiring an experienced DWI/DUI defense attorney is the first step in defending a drunk driving charge.

Cherry Hill, NJ, April 8, 2010 – Kevin Leckerman of Leckerman Law, LLC, a Cherry Hill based law firm specializing in defending Driving Under the Influence and Driving While Intoxicated cases, announced the publication of his newest article, “New Jersey and Refusal Cases: Where Did the Constitution Go?”.

In his newest article, Mr. Leckerman identifies a recent and perplexing shift in New Jersey constitutional law and municipal court procedure, where a defendant’s appeal, State v. Kim, was denied because he did not originally file a Motion to Suppress Evidence of refusing to submit breath samples. Additionally, the court ruled that the defendant failed to prove he did not understand the refusal warnings provided to him in English. This holding and new rules of law are contrary to the Due Process clause, Rules of Procedure 3:5-7 and 7:5-2, and the Refusal Statute (N.J.S.A. 39:4-50.4a).

“A DUI prosecution can be one of the most traumatic and stressful events of a person’s life. That is why hiring an experienced DUI attorney is the best choice a person can make when determining what to do when faced with a drunk driving charge. Inaccurate breath testing results may occur if an officer administering a test was improperly trained or not certified to conduct the test, or the testing device was malfunctioning. With extensive training and many thousands of hours of DUI litigation experience, I walk my clients into the courtroom with confidence that the right result will happen for them,” said Kevin Leckerman.
