According to California’s Office of Environmental Health Hazard Assessment (OEHHA), which is part of the California Environmental Protection Agency, they are “adding bromochloroacetic acid (CAS No. 5589-96-8), cumene (CAS No. 98-82-8) and diclofop-methyl (CAS No. 51338-27-3) to the list of chemicals known to the state to cause cancer for purposes of the Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65). The listing of bromochloroacetic acid, cumene and diclofop-methyl is effective April 6, 2010.”

The Safe Drinking Water and Toxic Enforcement Act of 1986 requires the Governor of California to revise and republish at least once each year the list of chemicals known to California to cause cancer or reproductive toxicity. The addition of bromochloroacetic acid, cumene and diclofop-methyl adds to the 21 page list of chemicals the state currently has designated on the Proposition 65 list.

In 2009, the National Toxicology Program (NTP) published a report that concluded bromochloroacetic acid and cumene can cause cancer. In 2000 the U.S. Environmental Protection Agency (EPA) published a report that diclofop-methyl can also cause cancer.

Proposition 65 requires anyone doing business in California not expose others to chemicals known to the state to cause cancer or reproductive toxicity without first giving a clear and reasonable warning. It also prevents those chemicals listed on Proposition 65 from being released into drinking water.

LA Testing, one of California’s largest environmental testing laboratories, provides testing services and supplies for a number of environmental contaminants including bromochloroacetic acid, cumene and diclofop-methyl. “LA Testing offers the most advanced testing solutions to ensure people are not exposed to cancer causing chemicals,” reported Ben Sublasky, National Director of Client Services for LA Testing and EMSL Analytical. “Municipalities, environmental regulators, environmental professionals and even the general public can utilize our modern testing laboratories.”
