Upon arrest, one is placed in the custody of a jail. The bail amount is set by either a court or by the jail staff using a countywide bail schedule established by the Superior Court Judges. Once the bail amount has been set, bail may be posted at the jail or court by posting either cash bail, a cashier’s check, or a bail bond. After bail is posted, the person is released from custody and will remain free while the court case proceeds. Bail is posted to insure that the person arrested will appear in court each and every time he or she is ordered to appear.
