On May 27, 2009, the Judicial Panel on Multidistrict Litigation (JPML) in Louisville, KY heard oral arguments requesting that all pending Chinese Drywall lawsuits filed around the country be consolidated and transferred to one jurisdiction for coordination. Parker Waichman Alonso LLP Chinese Drywall Litigation team argued to the Panel that the U.S. District Court for the Middle District of Florida, Fort Myers Division was the appropriate jurisdiction for this litigation, as Southwest Florida is the epicenter of the Chinese drywall problem, with the very first complaints coming out of Southwest Florida., but most importantly focused its argument that coordination of this litigation would lead to efficiency and consistency as these lawsuits move forward. The Panel is expected to reach a decision on this petition by mid-June.

In January, Parker Waichman Alonso LLP filed the first federal class action lawsuit on behalf of people whose homes were built with tainted Chinese drywall. The Parker Waichman Alonso LLP class action lawsuit, which was filed in U.S. District Court in Fort Myers, Florida, names the manufacturers of the defective drywall, Knauf Plasterboard Tianjin Co., Ltd., and Knauf Group, among others, as defendants. Since the January filing, 15-20 similar complaints have been filed by other firms in various federal jurisdictions.

About Defective Chinese Drywall
According to a recent Wall Street Journal article, the U.S. imported roughly 309 million square feet of drywall from China during the housing boom from 2004 to 2007. Residents of at least 16 states have complained about Chinese drywall that fills homes with a putrid, “rotten-eggs” odor, causes metals to corrode, and leads to sinus and respiratory symptoms in people living with the material. Recently, tests conducted by the Environmental Protection Agency found that samples of Chinese-made drywall contained sulfur and two organic compounds associated with acrylic paint that were not present in samples of U.S. made drywall.
