Rottenstein Law Group LLP Notes the Commencement of C.R. Bard Vaginal Mesh Trial After First Attempt Ended in a Mistrial

Bard trial that was declared a mistrial after an expert witness gave improper testimony. The second trial got underway on July 29, 2013 in the U.S. District Court for the Southern District of West Virginia.  
Plaintiffs Dan and Donna Cisson allege that C.R. Bard’s Avaulta transvaginal mesh implant was designed defectively and caused Mrs. Cisson to suffer serious injuries, according to court documents in Cisson v. C. R. Bard, Inc. (MDL-2187; 2:11-cv-00195; U.S. District Court for the Southern District of West Virginia).
The first trial was in its second day when a gynecology expert testifying on behalf of the plaintiffs mentioned during his testimony that Bard had removed its Avaulta transvaginal mesh device from the market in June 2012. District Judge Joseph R. Goodwin previously ordered that witnesses were forbidden from mentioning Bard’s marketing practices in their testimony, which prompted the defendants’ counsel to object to the testimony and call for a mistrial.
A new eight person jury has been empanelled, consisting of four men and four women. After the jury was chosen, the plaintiffs’ and defendants’ counsel presented opening statements. Plaintiffs’ testimony was scheduled to begin today.
