In the company’s Stockholders’ Newsletter for the first quarter of 2012, Bayer said it paid $142 million in the settlements, for an average of about $218,000 a case.

Also in the company’s report was confirmation that only serious blood clot injuries are being considered at this time, “Bayer is only settling claims in the U.S. for venous clot injuries (deep vein thrombosis or pulmonary embolism) after a case specific analysis of medical records.”Yaz, Yasmin and Ocella are oral contraceptives containing a synthetic hormone drospirenone.

Several independent studies have concluded that it appears drosprirenone may carry a risk of blood clots two to three times higher than other birth control pills that do not contain the hormone drospirenone. These blood clots can be serious leading to heart attacks, strokes and even death.

The US Food and Drug Administration (FDA) investigated data from more than 835,000 women who took pills containing drospirenone, such as Yaz, Yasmin and Ocella. As a result of these studies, on April 10, 2012, the FDA ordered Bayer as well as other manufacturers of oral contraceptives containing the hormone drospirenone to strengthen the black box warning on their products labels.


D. Miller & Associates, PLLC based in Houston, Texas is still accepting cases from those that have taken the birth control pills Yaz, Yasmin or Ocella and suffered from deep vein thrombosis or pulmonary embolism.

According to Madhu Sekharan, an attorney with D. Miller & Associates, they will be submitting cases to Bayer in May for review and consideration in the settlement discussions. “For those individuals who wish to be involved in the May discussions, time is of the essence.” according to Sekharan.
