Bruce P. Matez, Esquire was successful in persuading a judge of the Superior Court of New Jersey to dismiss/vacate a five year old domestic violence restraining order against his client.
Several months ago, Mr. Matez filed a motion requesting that the court dismiss and vacate a domestic violence restraining order entered against his client over five years ago. The parties have a child in common and have been embroiled in a bitter custody and parenting time dispute since the entry of the restraining order in 2005. The parties have had one prior custody trial, and have filed dozens of applications related to custody and parenting time issues over the past six years.
After what is called a Carfagno hearing (named after the New Jersey Supreme Court case which set the factors/criteria for the court to consider when asked to dismiss/vacate a domestic violence restraining order), a Burlington County Superior Court Judge dismissed/-vacated the restraining order against Mr. Matez’ client.
