Dermaroller® files first wave of federal trademark lawsuits against online micro-needle resellers and manufacturers

Sacramento, California, March 21, 2011 – Cynergy®, the U.S. agent of Dermaroller® S.a.r.l. has filed suits against skincare online reseller Wrinkle-Free-Skin-Tips.com, the website’s owner Linda Robison, and other online resellers, manufactures, and domestically based affiliates. Cynergy’s® suit against these online resellers is for trademark infringement and false advertising.

Despite numerous cease and desist letters from Cynergy®, companies are still selling micro-needle rollers illegally using the Dermaroller® trademark(s) over eBay, Amazon.com, Google, and other online websites.

César Maúrtua, MD, Cynergy’s® Medical Director explains, “Our top concern is for the unwary consumer who believes the false information provided on these online sites, then purchase products that belong in the hands of trained medical professionals. That’s because these unethical sites sell the public rollers with micro-needle lengths greater than 0.5 mm. This is a potential health hazard.”

Cynergy® is warning consumers, Caveat Emptor (let the buyer beware) when considering rollers from online sites.

Phillip Terrazas, Cynergy’s® Sales and Marketing Director warns, “Watch out for companies claiming to be ‘FDA Approved .” No such classification exists for this kind of Class I medical device. After appropriate registration, the only legal certification that the FDA grants is FDA Certified. Micro-needling roller companies falsely certify and fraudulently include the FDA logo on their website and packaging in order to look official. The FDA would never allow use of their logo to endorse a product. What consumers don’t realize is these copycat devices are sold from overseas, so they’re not liable for damages they may cause.”

Illicit use of the Dermaroller® Company’s trademark and design violates Federal Trademark Law, 15 U.S.C.§, 1051, et seq. (the “Lanham Act”); trademark dilution in violation of Section 43(c) of the Lanham Act, 15 U.S.C. § 1125(c); as well as trademark infringement, dilution, and unfair competition under state laws.
