Construction Worker Receives $1.3 Million after Falling from Scaffold - Cellino & Barnes Trial Attorney Stephen Ciocca

A 42-year-old man accepted a $1.3 million settlement for injuries he sustained after falling from a scaffold.

The plaintiff was working on a bridge project in Upstate New York. The day before being injured, the plaintiff and a co-worker set pins on a scaffold on their respective sides. The following day, as the plaintiff stood on his side of the scaffold, it collapsed underneath him, causing him to fall onto rocks below.

The plaintiff’s injuries resulted in an ankle surgery and multiple back surgeries.

There were serious issues with liability, as it was alleged the plaintiff failed to secure the pin on his side of the scaffold. The defendants had offered $250,000 and had indicated that the offer would not be increased.

The Friday before jury selection, the parties reached the settlement of $1.3 million.
