On March 5, 2015, according the order of Judge Ed Kinkeade, Third Amended Case Management Order, C. Calvin Warriner, III, a partner with Searcy Denney Scarola Barnhart &  Shipley, in West Palm Beach was recently appointed to serve on the Plaintiffs’ Steering Committee for MDL No. 2244. 

These consolidated federal court lawsuits are pending before Judge Ed Kinkeade in Dallas, Texas and involve thousands of individual plaintiffs who have allegedly suffered injuries and have undergone revision surgeries following their implantation with Pinnacle metal-on-metal hip implants manufactured and marketed by DePuy Orthopaedics. 

Mr. Warriner has been asked by the Steering Committee to focus his work on behalf of MDL No. 2244 on the development of expert witnesses to testify on behalf of the plaintiffs in future trials in the MDL, which are slated to begin in a few months.  Mr. Warriner has been able to bring to the Pinnacle MDL his breadth of experience in working with scientific experts regarding hip implant design and failure analysis. 

Cal Warriner reports that, “the Mass Tort Unit of the law firm of Searcy Denney Scarola Barnhart & Shipley represents hundreds of plaintiffs who have been injured by metal-on-metal and modular hip implants manufactured by DePuy, Stryker, Zimmer, Wright Medical, Biomet, and other manufacturers.”

Mr. Warriner also serves on the Plaintiffs’ Steering Committees for the Stryker Rejuvenate and ABG II Modular Hip Implant Litigation (MCL No. 296 in New Jersey state court) and the DePuy ASR Hip Implant Litigation (MDL No. 2197).  Mr. Warriner was personally involved in the negotiation of the landmark $1.4 billion settlement in 2014 of Stryker ABG II and Rejuvenate modular hip implant cases. 

Brenda Fulmer, another Searcy Denney partner, has been appointed to the Plaintiffs’ Steering Committee for MDL No. 2391 for Biomet metal-on-metal hip implants and on the Discovery Committee for MCL No. 296 for Stryker Rejuvenate and ABG II hip implants.
