Package Holiday Accident Claims – What Can You Do?

If you have had an accident whilst away on a package holiday, you may be able to claim holiday accident compensation when you return to the UK if the holiday providers are found to be at fault.

United Kingdom – WEBWIRE

Having an accident whilst on holiday is everyone’s worst nightmare. People need to be protected from sustaining injuries whilst at resorts, and if something does happen to them, they deserve to be compensated for the pain they have experienced, as well as their holiday being spoilt.

If you have had an accident whilst away on a package holiday, you may be able to claim holiday accident compensation when you return to the UK if the holiday providers are found to be at fault. People who are injured in an accident on a package holiday are protected by the Package Travel, Package Holiday and Package Tour Regulations.

Holiday accident claims is a complex area of the law therefore we would always advise you speak to reputable solicitors who can advise you on making a claim. First of all they will check whether your holiday is classed as a “package holiday”. Your holiday will only be classed as this if you booked all the components of the trip together as a whole. If you purchased each part separately, even if all on one site that facilitated you to do this, this may not be classed as a package holiday.

However, even if you did not travel using a package holiday, you may still be able to claim compensation and a solicitor can investigate this further for you.

Typical compensation for accidents covered by a package holiday include accidents in the hotel complex itself (including swimming pool accidents, in hotel lobbies and restaurants, in rooms and bathrooms etc.), on planned excursions if pre-organised through the provider, as well as accidents travelling on pre-arranged transfer buses or coaches.

Freeclaim holiday claims solicitors have put together guidance on what to do if you are unfortunate enough to experience an accident whilst on a package:

  • Report the accident to the hotel management immediately if it happened at the resort.
  • Speak to and report the accident to a holiday rep for the organiser available at the resort – do this whether the accident happened at the complex or for example off site on a planned excursion.
  • If there is no representative available at the resort, contact the holiday provider’s main office in the UK.
  • If you have travel insurance, make sure you contact your providers to advise them of the accident and any medical treatment you may have had, or be planning to have.
  • Make a note of the details of the accident and take as many photographs as you can.

Freeclaim Solicitors have over 25 years’ experience dealing with personal injury claims in the UK and helping clients who have suffered accident whilst abroad. We have successfully claimed holiday accident compensation for many people who have been injured whilst on a package holiday.

We recently secured compensation for a client who sustained injury when he slipped on wet ceramic tiles in a hotel on a package holiday to Costa Rica and sustained a fractured hip. The hotel tiles had become wet due to sprinklers either side of the path which were turned on in the evenings to water the surrounding plants. There were no warning signs to advise that the tiles may become slippery when wet, and that sprinklers would be turned on in the evenings.

Stephanie Hunt, a solicitor at Freeclaim Solicitors, who has experience in dealing with package holiday compensation claims, commented, “Having an accident whilst on holiday is everyone’s worst nightmare. People need to be protected from sustaining injuries whilst at resorts, and if something does happen to them, they deserve to be compensated for the pain they have experienced, as well as their holiday being spoilt.”
