Ocella Lawsuit Cases to be Included in Bayer Settlements

Houston, TX December 18, 2012 – Bayer has been hit with record numbers of lawsuits by clients injured by Yaz, Yasmin, and Ocella. Initially, there was a concern that Bayer might try to argue that Ocella would not be included in the lawsuits, as it is a generic drug and therefore protected by a Supreme Court ruling that makes it difficult to involve generic drugs in lawsuits.

However, since Bayer has started settling the Yaz and Yasmin cases, as well as the Ocella lawsuits, it appears that Bayer is not going to attempt to make an argument that Ocella is covered under the ruling protecting generic drugs from lawsuits.

These drugs all use the hormone, Drospirenone, which studies have found can more than double the risk for a blood clot related injury. Aware that the settlement process for these lawsuits can be extremely time consuming, Bayer is cooperating with the plaintiff’s lawyers to settle these cases.

This sincere effort by Bayer is encouraging news for the many women harmed by taking Yaz, Yasmin, or Ocella.

Many Ocella Lawsuit cases may not have been filed yet. The Ocella lawsuit was put on hold by many lawyers due to the uncertainty surrounding their eligibility for a settlement. Because of this, many Ocella users were discouraged from filing a claim initially.

Now that Bayer is settling Ocella lawsuits as well, more of those injured from Ocella are expected to file a claim.
