On February 24, 2012 U.S. District Judge F. Dennis Saylor ordered unsealed a case related to the drug Actos. Dr. Helen Ge , a medical doctor and former medical reviewer for the manufacturer of Actos, Takeda Pharmaceuticals, filed a whistleblower case on June 18, 2010.

The case claimed that Takeda did not fully report the risk of bladder cancer and congestive heart failure (CHF) among patients taking the diabetic drug Actos.

As a result of her complaints, she was let go from her position with the drug manufacturer. The Actos whistleblower lawsuit (U.S. ex rel. Helen Ge v. Takeda Pharmaceutical Co., 10-cv-11043, U.S. District Court, District of Massachusetts (Boston)) filed by Dr Ge, accuses Takeda of knowing about the risk of serious Actos side effects such as bladder cancer and CHF but minimizing the risks to in order to increase their profits.

Dr Ge had been hired to work in the Pharmacovigilance Department of Takeda to review the safety of drugs including Actos. She alleges that her supervisors ordered Dr Ge to downplay the seriousness of her findings concerning the bladder cancer and CHF risks with Actos.

The doctor states that while 100 bladder cancer events were reported to the company, Takeda only reported 72 events to the US Food and Drug Administration (FDA).

She also alleges that between 2007 and 2010 several hundred CHF cases were not reported to the FDA. According to the qui tam case, “Takeda instructed its medical reviewers not to report hundreds of non-hospitalized or non-fatal Congestive Heart Failure cases as ‘serious’ adverse events and thus avoided its responsibility of accurately analyzing and reporting these hundreds of serious adverse events to the FDA.

The law firm of D. Miller & Associates, PLLC has been accepting claims from patients that have taken Actos for their diabetes and developed bladder cancer based on earlier FDA findings.

However, in light of this new evidence filed by Dr Ge, the Actos team at D. Miller & Associates is also reviewing claims from individuals that have taken Actos and suffered from congestive heart failure.
