Muhammad Ali Sues Home Seller Due to Mold & Construction Defects

Yesterday, CBS News reported that Muhammad Ali and his wife are suing a couple they purchased a home from several years ago.  The home, purchased for close to $2 million, is located in Kentucky.  The suit claims the Ali’s were not informed of a host of defects in the property, including leaks and mold problems.
 
Property disclosure laws vary by state, but all require a host of issues to be disclosed to potential property buyers.  In Kentucky, these include the existence of mold, leaks, water problems, and the existence of asbestos materials and lead-based paint.
 
Homes that experience leaks and water infiltration events can quickly begin growing mold.  Once the mold begins to grow it can result in structural damage and begin releasing spores into the air.  These aerosolized spores can spread throughout the indoor environment and cause a host of potential health issues for the building occupants.
 
According to the U.S. Environmental Protection Agency (EPA), “Molds produce allergens (substances that can cause allergic reactions), irritants, and in some cases, potentially toxic substances (mycotoxins).  Inhaling or touching mold or mold spores may cause allergic reactions in sensitive individuals.  Allergic responses include hay fever-type symptoms, such as sneezing, runny nose, red eyes, and skin rash (dermatitis). Allergic reactions to mold are common.  They can be immediate or delayed.  Molds can also cause asthma attacks in people with asthma who are allergic to mold. In addition, mold exposure can irritate the eyes, skin, nose, throat, and lungs of both mold-allergic and non-allergic people. “
