Micro-needling Resellers Beware: Dermaroller® is Enforcing their U.S. Trademarks

Carson City, Nevada, March 8, 2011 – Cynergy LLC, the U.S. agent of Dermaroller® is actively and aggressively enforcing its trademarks to protect consumers from copycat micro-needling products. Many unethical companies sell their products online using a variation of the respected Dermaroller® name to mislead consumers. People who unknowingly buy these copycat products put their health at risk.

Dr. César Maúrtua, Cynergy’s medical director, warns, “The inferior micro-needling devices are known to cause skin damage, infections, and scarring. Needle tips have been reported to bend and tear skin during rolling or break off in the skin.”

“Protecting our trademark directly protects the consumer. These online, foreign-based and domestic resellers are selling rollers to medical professionals and consumers indiscriminately. These rollers are poorly designed, poorly manufactured, and are not sterilely packaged. They’re also selling wrong, excessive and dangerous needle lengths to the public. Some rollers have 2.5mm to 3mm lengths. That’s extremely dangerous because the skin is only 2mm thick in some areas. Penetrating too deeply can cause severe nerve and tissue damage,” explains Phillip Terrazas, Cynergy’s sales and marketing director.

Mr. Terrazas adds, “Others purposely mislead consumers by using our Dermaroller® name because we’re the original, most researched, trusted and largest micro-needle device manufacturer worldwide. But these copycats fall extremely short of Dermaroller’s® trusted quality and exacting manufacturing standards.”

For example, copycat devices claim the rollers can be sterilized with rubbing alcohol and reused. That’s dangerous because rubbing alcohol alone does not sterilize a medical device. Using rubbing alcohol in order to reuse medical rolling devices can also result in device damage, skin damage, infections and injury to the skin because the poorly manufactured needles can loosen and break.

Copycat devices also use acupuncture needles which do not have the strength required, thus risking injury. And, acupuncture needles can’t provide the therapeutic effects seen with quality engineered micro-needling devices like the Dermaroller®.

Another important note is that most micro-needling sellers are based overseas and do not have a US office. This allows them to make false claims about their products without being held liable for any damage(s) they cause the consumer. This leaves the consumer without recourse.

Cynergy’s retained counsel is sending out cease and desist letters to trademark offenders explaining, “Dermaroller® products have been sold for many years, therefore it is very unlikely that someone’s illegal use of the Trademark was innocent. Their intentional and willful infringement entitles Cynergy and the Dermaroller® Company to file an action in federal court and recover significant and statutory damages, attorneys fees and costs.”

Illicit use of the Dermaroller® Company’s trademark violates Federal Trademark Law, 15 U.S.C.§, 1051, et seq. (the “Lanham Act”); trademark dilution in violation of Section 43(c) of the Lanham Act, 15 U.S.C. § 1125(c); as well as trademark infringement, dilution, and unfair competition under state laws.
