DePuy Orthopaedics Reportedly Low-Balling Hip Replacement Patient Compensation in Exchange for Medical Records

Recipients of DePuy Orthopaedics’s recalled ASR XL Acetabular System and ASR Hip Resurfacing System are being pursued by the company with vague offers of compensation for “certain out-of-pocket medical expenses” in exchange for “simply” signing a release that will allow DePuy to have complete access to patients’ medical records. But these victims get no guarantee of compensation, only consideration on the part of DePuy. In the meantime, patients are at risk of having their private medical records exploited, while receiving little to no compensation for pain and suffering associated with the defective hip replacement devices. Giving DePuy complete autonomy to decide the fate of injured hip replacement recipients leaves them with virtually no recourse if they are dissatisfied with their settlements. Legal experts are advising hip replacement recall victims not to give DePuy the opportunity to determine the “limited and reasonable” costs associated with their ordeals. Instead, they should consider consulting a hip replacement lawyer, who can best determine the degree of compensation victims are entitled to. DePuy is not accounting for additional medical expenses incurred by patients as a result of the symptoms they began experiencing as a result of implantation of a defective hip replacement device. Instead, DePuy is willing only to reimburse for expenses incurred solely from its defective device. Compensation for lost wages, travel expenses, and pain and suffering are not included in the DePuy offer.
