EPA Ordered to Review California Air Pollution Rules

Recently the Ninth U.S. District Court of Appeals ordered the U.S. Environmental Protection Agency (EPA) to review its approval of California’s air pollution standards related to pesticides and ozone. The ruling came about after several groups challenged the EPA in court for approving in part, and disapproving in part, revisions to California’s state implementation plan for meeting Federal Clean Air Act standards.

The groups that challenged the EPA raised three primary issues in their petition for review. The federal appeals court agreed with all three arguments.

Air pollution is a major concern across California. It’s not surprising that there have also been reports of increased asthma rates in parts of the state. Just last month, in an article entitled “Asthma Problems Rise in Mid-Valley”, it was reported in the Appeal-Democrat that a greater share of Mid-Valley residents are having respiratory problems. The California counties of Yuba, Sutter and Colusa have all reported asthma rates significantly above the state’s 8.3% according to research by the UCLA Center for Health Policy. The three counties had asthma rates ranging from 10.8% to 12.3%. According to the article, “Researchers called the asthma threat a growing one, saying the share of current and former sufferers in California grew from 11.3 to 13 percent of state residents from 2001 to 2007, and from 14 to 15.4 percent among children younger than 18. Some 3 million Californians had the condition in 2007.”
