The Five Kinds of Compensation You’ll Get by Filing a DePuy Hip Replacement Lawsuit

DePuy Orthopaedics, a division of Johnson & Johnson, recalled its ASR Acetabular System and ASR XL Hip Resurfacing System in August, 2010, after it was determined that about 12 percent of patients were experiencing failure of these devices approximately 5 years after implantation. Despite these alarming statistics, DePuy has not been doing right by recipients of its defective hip replacement devices. The compensation offering doesn’t come close to paying all the costs associated with the procedures needed to address the pain and suffering patients have been experiencing because of the faulty hip implants.
DePuy is more than willing to pay for an amended surgery, but are not compensating patients directly; instead, it is paying Medicare, or the patient’s insurance carrier. Any discrepancy, including fees and other administrative costs are to be borne by the patient, not DePuy. Since patients were not anticipating having to undergo a correction to the procedure, this is unacceptable. When patients join a hip replacement lawsuit, they will receive compensation for medical costs, including the hiring of a caregiver, travel expenses, loss of income, scarring and disfigurement and pain and suffering. Without the help of a compassionate hip replacement lawyer, claimants can be forfeiting much of what they could get by dealing directly with DePuy.
