Sugar Run, PA - October 29, 2010 -Parker Waichman Alonso LLP announces that they have filed a lawsuit against Chesapeake Appalachia, LLP, Chesapeake Energy Corporation, and Nomac Drilling LLC on behalf of a woman from Bradford County, Pennsylvania. Judy Armstrong, a resident of Sugar Run, PA, alleges that her water well has been contaminated due to gas drilling operations being conducted by the defendants. According to the complaint, beginning in 2009, Chesapeake Appalachia and other named defendants engaged in drilling activities, and owned and operated several natural gas wells in Terry Township, Bradford County. The wells are located approximately within 3 miles from Ms. Armstrong’s residence on Quicks Bend Road in Sugar Run, where she relied on a ground water well for drinking, bathing, cooking, washing and other daily residential uses.
Ms. Armstrong’s lawsuit alleges that because of the drilling activities caused methane, ethane, barium and other harmful substances to enter into and contaminateher water supply. The lawsuit further alleges that the contamination was the due to the negligence and activities of the defendants’ drilling operation, including use of improper drilling techniques and materials, and defective and ineffective well casings, as well negligent planning, training and supervision of staff, employees and/or agents.
Among other things, this contamination caused Ms. Armstrong to suffer personal injury including contact dermatitis, gastro-intestinal discomfort, barium poisoning, pain, numbness to her face and hands, deformities of the bones of her hands, and headache, among other injuries. She continues to live in fear of future physical illness, the complaint alleges.
The lawsuit further alleges that the value of the Ms. Armstrong’s property has diminished, and she has lost the use and enjoyment of her property, and the quality of life she otherwise enjoyed.
The lawsuit seeks a preliminary and permanent injunction barring the defendants from engaging in the acts cited by the complaint, as well as abatement of the nuisances, unlawful conduct, violations and damages created by those acts. It also seeks, among other things, compensatory damages, punitive damages, and the cost of future health monitoring.
