Proposed Settlement Could Help to Mitigate Lead Paint Hazards from Thousands of California Homes

The VC Star recently published an article about a proposed multimillion dollar settlement of a public nuisance lawsuit filed by Santa Clara County. The lawsuit, filed back in 2000, was against three lead paint manufacturers. One of those companies has reportedly agreed to settle and pay approximately $60 million into a fund that would be used to remediate lead-based paints from homes in California.

In the past, lead was added to paints used inside and outside of homes and other buildings due to its ability to enhance corrosion resistance, durability and pigmentation. These paints were sold up until 1978 and according to some estimates, more than 38 million homes in the country contain them. In certain parts of California, a huge percentage of homes were built prior to the 1978 ban on lead-based paints. For example, the Environmental Services Department in San Diego reports that 70% of the city’s housing was constructed before then and that 28% of it was built before 1960, a time when residential paints commonly had a high lead content.

“It’s well documented that one of the greatest lead poisoning exposure risks is due to contact with lead-based paints,” said Michael Chapman, Laboratory Manager at LA Testing’s Huntington Beach facility. “Exposure could be the result of normal wear and tear of lead-based paints which creates lead dust or due to paint flakes and other forms of deterioration. Another common source of lead exposure can result during renovation, remodeling and demolition activities, especially during DIY projects, if the proper safety precautions aren’t put in place.”
