In Wal-Mart Trampling Case, Gersowitz Libo & Korek, P.C. Fight for Victim’s Family

Attorneys appalled by Wal-Mart – Nassau County DA Settlement Agreement

New York, NY – In a shocking twist regarding the death of Jdimytai Damour, the temporary Wal-Mart worker, who was stampeded to death on November 28, 2008, the day after Thanksgiving, or Black Friday as it is commonly known, Wal-Mart and the Nassau County District Attorney’s Office have reached an “agreement,” and the District Attorney’s Office has terminated their criminal investigation.

The family of Jdimytai Damour, represented by the law firm Gersowitz Libo & Korek, P.C., was never notified of this agreement before it became public, and is shocked, frustrated and saddened by the ill conceived pact between the corporate retail giant and the Nassau County District Attorney that provides for future safety protocols described as “too little, too late,” by Andrew Libo, an attorney for Damour’s family.

Libo had the following to say, “It is shameful that the family was never notified that there were secret negotiations between Wal-Mart and the Nassau County District Attorney before they were made public. Jdimytai’s family should have been given the chance to take part in the discussions surrounding this tragedy – a tragedy which has devastated the lives of Jdimytai’s family.”

Incensed and full of disbelief about the Wal-Mart agreement, Libo went on to state, “The ability of Wal-Mart to dictate the results of this criminal investigation demonstrates the epitome of corporate arrogance that has become all too familiar in this day and age, and shows how Wal-Mart has nothing but contempt for the victims of such corporate malfeasance. Justice has not been served and those responsible must be held accountable for their actions.”

David Paterson of New York to appoint a special prosecutor.
