Shocking Case of Negligence Leads to Death of Heroic Husband

New York, NY – The family of the first New York kidney donor to die of transplant surgery has retained Jeff Korek, the Immediate Past President of the New York State Trial Lawyers Association and his high-profile personal injury law and medical malpractice law firm Gersowitz Libo & Korek, P.C. for the purpose of legal representation.

Michael King, 29, had just undergone kidney transplant surgery on October 27, 2008 at SUNY Downstate Medical Center in Brooklyn in order to save the life of his wife, ShellyAnn, who was suffering from severe illness and required dialysis three times a week. What was supposed to be a typical recuperative process turned into ShellyAnn’s worst nightmare, the death of her husband, Michael.

Mr. King died from complications arising due to a defective medical device called a Hem-o-lok clip. This device was used to close an artery in the affected area in Mr. King’s body after surgery. The manufacturer of the device, Teleflex, sent warnings to all of its customers in August 2006 to cease use of the Hem-o-lok clip, yet the chief transplant surgeon at SUNY Downstate Medical Center had continued to use the faulty device, Illustrating a grave case of medical negligence on the part of an otherwise respected medical institution. The FDA even posted the manufacturer’s recall of the device that same year after eight other kidney donors had died after transplant surgery.

To make matters worse, SUNY Downstate’s standard of care protocols fell far short of what is expected of a major hospital. When Mr. King started bleeding internally eleven hours after surgery, he had to wait unattended to by a surgeon until the chief transplant surgeon, Dr. Distant, the same doctor who had used the defective medical device on Mr. King, arrived at the hospital from his home more than an hour away. This long wait took place despite the fact that there were readily available surgeons in the hospital, the use of which may have saved Mr. King’s life.

Mr. Korek, the family’s attorney, stated “It’s inconceivable that on a weeknight in a major New York hospital, no surgeon was able to assist Mr. King.“ Mr. Korek went on to say, ”If you need immediate surgery, where better to be than in a hospital"
