Mother of deceased says son was “the only person in my life,” now wants justice

New York, NY – The family of slain Wal-Mart employee Jdimytai Damour who died on November 28, 2008, the day after Thanksgiving, or Black Friday as it is commonly known, has retained Jeff Korek, the Immediate Past President of the New York State Trial Lawyers Association and his high-profile personal injury and medical malpractice law firm Gersowitz Libo & Korek, P.C. in the search for civil justice.

Jdimytai, 34, had been hired as a temporary maintenance worker at the Wal-Mart at Green Acres Mall in Valley Stream, New York. On the morning of November 28, 2008 Jdimytai had been assigned door duty, despite never receiving any security training or assistance. A large crowd of eager shoppers morphed into an anxious mob and eventually broke down the front doors, creating a panic. In trying to keep the customers safe, and in particular trying to keep a pregnant woman from being trampled on, Jdimytai lost his life.

Mr. Korek stated that this case “represents a tragic loss of life which the family will never overcome.” He went on to say, “myself, and everyone at Gersowitz Libo & Korek, P.C. will not rest until justice has been served and Jdimytai’s family receives closure knowing that his heroic efforts to save others has not gone unnoticed.”

Marie Telismond, Jdimytai’s mother, has sadly noted that Jdimytai was “the only person in my life. Now I am alone, all alone.”

The outrage this case has generated has spurred legislative action. The Nassau County Legislature is drafting legislation regarding retail safety and New York City Councilman Jim Gennaro has introduced legislation concerning the same topic.
