Atlanta Legal Nurse Consultant Assists Attorneys With Trucking Case - Jury Awards $20 Million Verdict

Atlanta, Georgia -- January 6, 2009 – Atlanta Legal Nurse Consultant, Liz Buddenhagen, RN, CLNC, assisted attorneys with medical aspects of a wrongful death case involving a sleep deprived truck driver and a schoolteacher driving to work.

The result was a $20 million verdict.

Here’s what happened: A 62-year-old Atlanta area schoolteacher suffered broken ribs when his car was rear-ended by a supply truck. The schoolteacher was stopped at a red light when the truck crashed into his vehicle. He subsequently died in the hospital of complications. Neighbors say the teacher was highly regarded by his students and respected for his volunteer work for the homeless.

The truck driver was working a day job. He also had a night job, surviving on as little as three to four hours of sleep each day. Authorities say this lack of sleep ultimately contributed to the deadly accident that killed the teacher.

Approximately one week before trial, the medical expert just named for the defense attorneys tried to blame the treating physicians for failing to save the teacher’s life.

“The plaintiff attorneys initially hired our firm to review medical records, summarize and create a timeline of the past medical history of the deceased schoolteacher,” said Buddenhagen. “After attending a deposition of one of the treating physicians, our firm created a chronology of the hospitalization following the accident and reviewed the medical care rendered,” she said.

One week before trial, Buddenhagen said she and her team located an appropriate medical expert to review, opine and testify in court about the quality of care the schoolteacher received at the hospital.
