Felony Complaints Filed Against California Company for Releasing Cadmium and Other Heavy Metal Particulates

Recently, California Environmental Protection Agency’s Department of Toxic Substances Control (DTSC) announced that one of their investigations has led to the filing of felony complaints by the Los Angeles County District Attorney’s Office against a local metal recycling firm and its owner. The complaint alleges five felony counts for violations of California’s hazardous waste control laws. 

According to the DTSC, their Office of Criminal Investigations (OCI) collected evidence that indicates the company released toxic levels of metal particulates onto the public sidewalk in front of its facility in Maywood. The criminal complaint states that the company knowingly disposed of, treated and stored hazardous waste, which included cadmium and other heavy metals, at the facility without a permit from DTSC.

Cadmium is a naturally occurring element.  Approximately three-fourths of cadmium is used as an electrode component in some types of batteries, with the remainder used in pigments, coatings and platings, or as a stabilizer for plastics. Cadmium and cadmium compounds were added to California’s Proposition 65 list of materials known to cause cancer, birth defects or other reproductive harm in 1987. It requires businesses to inform Californians about exposures to such materials.

“Workers and the public can be at risk if they are exposed to cadmium particulates, dusts or fumes,” said Michael Chapman, Laboratory Manager of LA Testing’s Huntington Beach facility.  “According to OSHA, serious adverse health effects from long-term exposure to cadmium include kidney dysfunction, lung cancer and prostate cancer. Cadmium may also cause local skin or eye irritation, and can affect long-term health if inhaled or ingested.”
