Papros: Appeals Court Ruling Encourages Responsible Conflict Free Sourcing for Dodd-Frank

Responsible is the key term in conflict free sourcing

He stated today that most leading companies in the world are encouraging their supply chain to use the free version of MRPRO(TM) as licensed through the CFSI (Conflict-Free Sourcing Initiative). 

EICC and later CFSI, had, in the interest of increasing supply chain ease data fluidity for the special case of human rights, entered into such a unique arrangement.

The latest developments in the field, including the Appeals court ruling, suggest that  in sourcing per the rules, the courts would expect companies to do a good faith effort in reducing conflicted sources for their minerals, but recognizes that their primary focus is on their business and responsibly derived profitability for their products. 

The level of good faith in this context points to the desired process. As one supply chain practitioner said “For the process to work well, what is needed is the concept of  Responsible Conflict Free, because in many cases, companies can use supplier parts that simply totally avoid sourcing from certain areas as matter of policy, which could be counterproductive to the purpose of Dodd-Frank”.

This is often the undesired secondary side effect of BOM based tracking, where it is easy to “cleanse” the BOM. Thus BOM based conflict mineral compliance leads to needless counterproductivity of purpose while simultaneously increasing multiple tasks for the supply chain. While the want to be “clean” is certainly the driver for market reasons, how that is done is certainly as important for the root purpose of the Dodd-Frank. From that vantage point, supplier and division level conflict mineral tracking seems far more sensible and will produce desired results.
