Could the Insurer’s war against ‘spurious’ whiplash claims be frightening genuine victims of road traffic accidents?

Legal reforms put into place in 2013 may have helped cut third-party motor insurance claims for the first time in a decade, but have certain insurers attempted to scare people away from making claims?

Legal reforms in the sector such as bans on referral fees and a crackdown on claims management companies (CMC’s) in 2013, has led to many people being put under increased scrutiny by insurers when making a road traffic accident compensation claim.

Figures released by The Institute and Faculty of Actuaries show claims fell by 10% in 2013, with the cost of road traffic accident compensation claims falling from £354m to £238m – a huge 33%. This is despite the picture that is being painted by insurance companies of a ‘whiplash epidemic’ in the UK.

Although insurers such as Aviva are promising that customers will benefit from the reduction in compensation claims as insurance premiums will drop, this is little comfort for genuine victims of whiplash seeking compensation. Car insurance giant Aviva are boasting a £50m saving in costs, stating that they have won over 200 cases against ‘spurious’ low speed whiplash claims in 2014 alone. Solicitors are viewing this as part of another scaremongering tactic by insurance companies who are trying to stop people from making claims.

Freeclaim Solicitors are urging victims not to be dissuaded from claiming compensation after a road traffic accident. Emma Greenhalgh, Head of the Road Accident Department at Freeclaim Solicitors commented, “Whiplash injuries can have a serious impact on someone’s life, and people should not be put off making a claim if they have sustained whiplash or other injuries in a road traffic accident. We see on a daily basis the pain and suffering people experience as a result of whiplash, and they deserve to be compensated for this. I would urge anyone with whiplash symptoms or other injuries following an accident to speak to specialist road traffic accident solicitors who can advise on a compensation claim.”
