Commercial Tenant in Bakersfield Faced with Mold Dilemma

Last month, KBAK broadcasted a story about a Bakersfield, California business owner and her unexpected discovery that has disrupted plans for her new endeavor.  According to the report, the business owner thought she had found the perfect location to open her new business and signed a lease.  Shortly after signing the lease, she noticed a musty smell in the bathroom.

Upon further investigation, she noticed what appeared to be mold growing below the sink.  The wall cavity was then opened and extensive mold growth was found.  The news report states that the landlord says the damage was from a previous leaky roof issue that had been fixed and that since the business owner had already accepted the building, any changes would be her responsibility. An area code enforcement officer was also interviewed for the story and he reported that deciding who pays for the repairs is a civil matter and it is dependent upon how the lease was written.
