Santa Clara Couple Sued by Neighbor over Lead Concerns from Remodeling Project

Last month, NBC Bay Area broadcasted a report about a Santa Clara couple being sued by their neighbors.  The problem began when the couple began remodeling their Victorian house.  According to the lawsuit, the project caused toxic lead to enter the neighbor’s property.

Renovation, remodeling and demolition projects will typically generate a significant amount of dust and debris. Depending on the home, building and type of project, this dust can spread throughout the project area and even onto neighboring properties.  In many older structures, the dust and debris may contain a number of hazardous substances.  These may include lead from lead-based paints, as is the claim in Santa Clara, or other hazardous materials such as asbestos, mercury and PCBs.

“When any project is about to take place, it’s important to first know what hazardous materials may be present in the home or building,” said Michael Chapman, Laboratory Manager at LA Testing’s Garden Grove facility.  “It is also important to minimize exposure to these materials by controlling the amount of dust created and wearing personal protective equipment.  Isolating the project area from the rest of the building will also help to stop the spread of these dusts.  Depending on the situation, there may also be regulations that must be followed to protect people and the environment.”
