Medical Panel for Whiplash Injury Claims to go ahead

The Ministry of Justice have announced that, as proposed a few months ago, work will shortly begin to create a specific medical panel to deal with whiplash personal injury claims. The Government proposed reforms in relation to whiplash claims back in October 2013.
 
These reforms included the setting up of a medical panel to individually assess whiplash claims, accurately diagnosing whiplash and eliminating fraudulent claims, and also increasing the small claims limit so that more people would have to represent themselves in whiplash cases, rather than using an independent expert solicitor.
 
This announcement of a medical panel being formed is the Government’s first steps to introducing these reforms. It is thought the panel will be made up of professionals across many bodies including The Law Society and the British Medical Society, as well as expert solicitors and insurers. The Government hope that this panel will help to decrease the number of whiplash claims put forward in the UK, and eliminate false claims for compensation.
 
Once this panel is introduced, medical reports in relation to whiplash claims will be required from accredited medical experts, with specific knowledge in whiplash injuries. Ensuring that all claims are fully assessed by medical professionals would also stop insurers making pre medical offers in order to settle claims quickly, and would ensure that all cases are assessed fully.
