The Rottenstein Law Group LLP Notes Mistrial in C.R. Bard Mesh Case

Bard and other companies, notes the declaration of a mistrial in a case against C.R. Bard that recently went to trial in a federal court in West Virginia.

The trial was in its second day when a gynecology expert testifying on behalf of plaintiff Donna Cisson mentioned during his testimony that Bard had removed its Avaulta vaginal mesh device from the market in June 2012. District Judge Joseph R. Goodwin ordered earlier that witnesses were forbidden from mentioning Bard’s marketing practices in their testimony, which prompted the defendants’ counsel to object to the testimony and call for a mistrial. Judge Goodwin granted the mistrial, according to Bloomberg.com.

“The testimony of the witness was unfortunate,” said Rochelle Rottenstein, principal of the Rottenstein Law Group LLP. “That he veered outside the parameters is not a reflection of the viability of transvaginal mesh lawsuits, though. It just means that he probably made a mistake.”

As with other plaintiffs in In Re C.R. Bard, Inc., Pelvic Repair System Products Liability Litigation (MDL-2187; U.S. District Court for the Southern District of West Virginia), Ms. Cisson has alleged that her Bard Avaulta transvaginal mesh implant injured her, according to documents filed in Cisson v. C.R. Bard Inc. (2:11-cv-00195; S.D.W.Va.). The trial was scheduled to last 12 days.

There are three more federal bellwether vaginal mesh trials scheduled: The next will get underway on July 29th, followed by another on August 19th and the third on September 9th.
