Fosamax trial shows evidence that Merck knew of the drug’s fracture risks

Houston, TX April 10, 2013 – The second trial in a Fosamax lawsuit against Merck alleging that their osteoporosis drug, Fosamax, caused femur fractures began earlier this week in New Jersey.

In his opening statement, the plaintiff’s attorney, Paul Pennock, told the jury they would see evidence that Merck knew of the risk of femur fractures five years before Fosamax was approved. He also alleged that Merck violated federal regulations by not revealing the dangers associated with Fosamax.

Fosamax was approved by the FDA in 1995 to treat and prevent osteoporosis and other bone loss-related issues. In 2010, the FDA put out a warning on Fosamax after safety trials showed there was a risk of suffering from atypical femur fractures when the drug was taken for an extended period of time.

The plaintiff in this trial is a 59-year-old woman who took Fosamax for more than six years and suffered a femur fracture when she bent over to pick something up. The type of femur fracture people are experiencing is considered very rare and generally only occur from a traumatic event.This is just one out of the nearly 4,000 Fosamax cases currently filed in the multidistrict litigation (MDL).

Merck still maintains its position that it adequately warned patients of the potential risks associated with taking Fosamax. However, this trial will aim to prove that Merck did not fulfill their obligation to warn Fosamax users about the risks associated with the drug.
