Da Vinci Surgical System Lawsuit Update: Device Sees Earnings Increase in Fourth Quarter of 2012 Despite Lawsuits, the Rottenstein Law Group Reports

Despite a growing number of Da Vinci Surgical System lawsuits, Marketwatch said that manufacturer Intuitive Surgical saw healthy fourth-quarter earnings of about $175 million in 2012. The Rottenstein Law Group monitors this news with concern.

Intuitive Surgical attributes its 16 percent earnings increase in Q4 of 2012 over 2011 to increased implementation and sales of the da Vinci robotic surgical system, according to Marketwatch .

“Advances in medical technology should be encouraged, of course, but innovators need to be sure they prioritize a patient’s health,” said Rochelle Rottenstein, principal of the Rottenstein Law Group, a da Vinci Surgical System law firm. “As more hospitals adopt this technology, they need to be sure they are acting in the patient’s best interest and not simply to compete in a hospital technology ‘arms race.’ ”

The da Vinci system, billed as a high-tech tool to provide surgeons with greater precision, has been plagued with problems and was the subject of major lawsuits, including a March 2012 lawsuit involving a Bronx woman who died after receiving a hysterectomy via the da Vinci (Case No. 1:2012-cv-02597 in the United States Circuit Court for the Southern District of New York).

According to a Chicago Tribune story, Intuitive has sold more than 1,500 units of the da Vinci, a system that went through the U.S. Food and Drug Administration’s 510k fast-tracked regulatory system. Side effects include burns and lacerations to organs and blood vessels. Surgeons in hospitals across the county have performed more than 250,000 hysterectomies and prostate removal surgeries, according to the Chicago Tribune story.
