After 9 months of painstaking research and legal work, Asons Solicitors has succeeded in obtaining substantial hearing loss compensation for a former bricklayer who had suffered noise induced hearing loss (NIHL) of 11 decibels as well as mild tinnitus.

Daniel Cartwright, 62, was exposed to industrial noise from a variety of sources including compressors, concrete mixers, hammering, drilling machines, fork lift trucks, lorries and more; all through his day-to-day work on-site. Mr Cartwright’s role was largely concerned with the manufacture of chimney pots and air bricks at Redbank Manufacturing Co Ltd.

Working as a Maintenance Bricklayer between 1966 and 1992, Mr Cartwright’s hearing gradually worsened to a point where it was causing problems during his everyday life. He now needs to wear hearing aids for the rest of his life.

“It got to a point where I had to keep asking people to repeat themselves, and I found it hard to follow a conversation when there was background noise; particularly in noisy places, down at the pub for example. It was then I realised that I needed to speak to someone about it

After consulting with Legal Executives at Asons, it appeared that Mr Cartwright’s work may have been responsible for his hearing loss, and so a specialist audiologist was scheduled to visit him. After testing his hearing, Asons were able to prove that his hearing loss was indeed work induced. 

Upon further investigation, it was found that Mr Cartwright’s past employers had not offered him adequate hearing protection, despite the fact that it was their legal duty to do so. Redbrick’s insurer was then sought, to obtain damages to compensate Mr Cartwright for the cost of his hearing aids and for the future ramifications of his lost hearing.

After extensive work, Asons were able to secure £8,000 for Mr Carwright to help towards the costs of supportive aids and equipment.
