Tampa criminal lawyer Nicole Denmon from Denmon & Denmon Trial lawyers has successfully defended her client, who is now a free man, after being found not guilty of a robbery with deadly weapon charge despite being positively identified by the alleged victim as the person who allegedly committed the crime.
According to the police reports, the client allegedly robbed the victim at gun point at a local apartment complex in afternoon. The victim called the police and stated that he was able to positively identify the defendant through a stocking. The victim identified the client in a photo pack after only three seconds. The State also presented testimony from a witness who allegedly overheard the client and another individual discussing a robbery plan the day before the actual robbery took place.
Under the Florida laws, the crime of robbery with a deadly weapon is defined as the unlawful and intentional taking of property or money from another person using threat, force, violence, or assault while in possession of a deadly weapon.  This crime is punishable by a maximum of life in prison with minimum mandatory imprisonment of 10 years.
The State offered nothing less than 10 years of imprisonment to the client.
