Clinical Negligence Victims ’to Be Silenced’ by Proposed Legal Aid Cuts
Britons thinking of pursuing clinical negligence compensation claims could be significantly affected by the government’s proposals to cut legal aid.
Britons thinking of pursuing clinical negligence compensation claims could be significantly affected by the government’s proposals to cut legal aid. Many will not be able to access legal advice and justice if the government’s proposals are implemented.
Legal aid is an initiative that helps children and adults with limited finances afford legal advice and representation.
Justice secretary Kenneth Clarke proposes that £350 million a year be cut from the legal aid budget with all funding for clinical negligence cases is to be removed.
According to the Law Society, these measures will leave a large proportion of the British public “in a legal black hole”, with Birmingham expected to be one of the worst-hit cities in the UK.
Richard Miller, head of legal aid at the Law Society, said: “By cutting legal aid funding, access to the courts, legal advice and representation will be drastically reduced. Those needing help in cases of medical negligence, divorce, employment and welfare will no longer have access to justice. These people will effectively be silenced, as their cases will go unheard without the support of a legal aid lawyer.”
Richard Money-Kyrle, solicitor at clinical negligence specialist Darbys Solicitors, commented: "Here at Darbys, we have helped hundreds of people achieve justice in clinical negligence cases funded under the legal aid system.”
“The complexity of clinical negligence cases means that specialist legal advice and expert medical assessment is necessary before the claim is put to the treating medical practitioner. Removing access to funding will result in many negligently injured people receiving no recognition or financial help. The support of legal aid is crucial to ensure justice for the most vulnerable in society.”
