DePuy Orthopaedics Inc. et al., plaintiff Anna Maria Sillman alleges that the Pinnacle hip replacement device is “unsafe and has not been tested” and that DePuy’s avoidance of pre-market testing of the device, claiming substantial similarities to existing devices already approved by the U.S. Food and Drug Administration (FDA) was inappropriate, considering that the older devices themselves never underwent appropriate testing. Ms. Sillman’s lawsuit is claiming that DePuy should have recalled the Pinnacle hip device “years ago,” as a result of “over 1,300 adverse events” related to the device reported to the FDA.
The “adverse events” referenced in the lawsuit refer to the loosening of the device after implantation, leading to severe pain experienced while performing normal movements and simple tasks. An additional problem with the Pinnacle system, as reported by The New York Times in December 2010, shows that the metal-on-metal composition of the Pinnacle system may cause metal to flake off the device and embed itself into surrounding tissue, putting the recipient at risk of developing metal poisoning.
