Rottenstein Law Group Urges Friends and Relatives of Hip Replacement Recipients to Encourage Them to Seek Advice from Professionals

In August, 2010, the U.S. Food and Drug Administration (FDA) recommended a recall of DePuy’s ASR hip replacement systems due to an unacceptable failure rate of 12 percent within five years of the initial hip replacement surgery. The ASR devices were given quick approval for sale in the U.S. predicated on their substantial similarities to the already approved Pinnacle devices, also manufactured and sold by DePuy.
The FDA is now receiving complaints about the Pinnacle systems, more than 500 to date, citing a loosening of the device that causes severe pain when the recipient performs the most basic of physical tasks. Additionally, the New York Times has reported on another significant problem with the Pinnacle devices: Due to their metal-on-metal composition, particles flaking off from the devices may embed themselves in surrounding tissue, putting the recipient at risk of developing metal poisoning. At least one lawsuit has been filed so far alleging this very issue with the Pinnacle system.
There has been no recall of the Pinnacle devices, but, having requested the removal of DePuy’s ASR systems from the market, the FDA is likely watching the Pinnacle situation very carefully. According to its public filings, Johnson & Johnson set aside $922 million of its reported $1.8 billion 2010 profit for litigation regarding the ASR hip replacement systems. If there is a significant rise in the already numerous complaints about the Pinnacle systems, Johnson & Johnson might be forced to recall these devices, which could lead to a DePuy Pinnacle class action lawsuit.
