Medical Negligence Costs Welsh NHS £90m Over 3 Years

Some £90 million has been paid out in compensation by the Welsh NHS over the past three years as a result of medical and clinical negligence, it has emerged.

The Western Mail states details of a wide range of legal cases between 2007 and 2010 have recently been revealed, with the majority involving life-long injuries - such as cerebral palsy - caused by mistakes during labour.

In addition, substandard treatment, misdiagnosis and surgical mistakes are cited as other reasons for compensation claims against the organisation, leading to £38.8 million being disbursed in 2007/8, £18 million in 2008/9 and £31.4 million in 2009/10. The largest sum paid out in one go was £11.8 million.

Commenting on the figures, Richard Money-Kyrle, lawyer and clinical negligence expert at Darbys Solicitors LLP says: “These statistics are shocking, not least because they highlight the seriousness of the errors made by some health professionals in the country. Those injured by negligent medical mistakes must maintain their right to compensation and have proper access to justice. The present government proposals to change funding for medical negligence cases is driven by a desire to save money even at the expense of justice for victims of negligent medical faults.”

He adds: “However, the research also proves the importance of successful medical negligence compensation claims to those injured following mistakes.

“While compensation cannot right the wrongs of the past, it can go a long way to improving the quality of life for victims and their families, potentially covering the cost of such essentials as treatment, rehabilitation, care, loss of earnings and property adaptations.”
