The Rottenstein Law Group Advises Against DePuy Hip Recall Claimants Accepting Settlements

WEBWIRE

(New York, NY, December 28, 2010) The Rottenstein Law Group, a firm representing claimants in the DePuy hip recall lawsuit, is advising claimants not to accept settlements offered by DePuy Orthopaedics in lieu of filing a lawsuit without discussing the offer with a lawyer. By consulting a hip replacement lawyer, you increase your chances of increasing the amount of damages you will receive, if you are one of the thousands of people who have been affected by the August 2010 recall of DePuy’s ASR Hip Resurfacing System or ASR XL Acetabular System.
As of October 2010, DePuy, a division of Johnson & Johnson, initiated a collaborative effort with a global insurance provider, to persuade claimants to turn over their medical records for evaluation. By having their records evaluated by an independent third party, DePuy is attempting to offer what they deem adequate compensation, without resorting to litigation. In reality, DePuy is attempting to use claimants’ medical records against them, in order to minimize the amount of compensation offered to patients who have been harmed by their recalled hip replacement devices. By attempting to offer what they feel is “reasonable and customary” compensation, DePuy is omitting compensation for pain and suffering, as well as lost wages. Reimbursement will only include the costs associated with “testing and treatment.” Additionally, by accepting a settlement from DePuy, a claimant waives all rights to file a hip replacement lawsuit against the manufacturer.
DePuy’s hip replacement devices were recalled in August 2010 after it was determined that 1 in 8 implant procedures were failing approximately 5 years after implantation. Approximately 93,000 patients worldwide have been affected by the recall, citing symptoms such as chronic pain, swelling, tumors, and increased amounts of metals found in the bloodstream, among others. Many patients will have to undergo a revision surgery to correct or replace a defective implant, which entails a prolonged and painful recovery. The Rottenstein Law Group advises patients to visit its DePuy hip recall Web site, www.hiprecalllaw.com, to read about the DePuy hip recall, and to determine whether or not they have been affected by these defective and dangerous devices.
